Terms and Conditions
By the supply of a Purchase Order to Web Design By The Bay for the development of web applications, the following terms and Conditions are agreed to:
Payment terms
A non refundable deposit of 40 % is required before the commencement of work and final payment is due at the end of work completion before the website is handed over. Our preferred method of payment is direct debit.
GST
All prices include GST.
Errors, Changes and Liabilities
All authors’ corrections, changes to specifications and alterations to specified Functions and deliverables will be charged as additional work outside this contract.
The client will obtain all the necessary permission and authorities in respect to the use of all copy, graphic images, registered company logos, names and trademarks or any other supplied material to be viewed on site. Evidence of permission and authorities may be requested. No responsibility will be accepted by Web Design By The Bay for damages to or losses incurred by the client from the use of material for which the required permission or authority has not been properly obtained.
Web Design By The Bay will be responsible for errors within the contracted specifications. Web Design By The Bay will not be responsible for errors after the website has been completed and approved. Also Web Design By The Bay cannot be held responsible for faults, and errors arising from work done by third parties outside the scope of this Agreement.
Unless otherwise expressly provided, Web Design By The Bay shall not be liable or responsible for any loss, damage, injury to property or persons (including but not limited to loss or profit, production, raw materials, end products or loss of use of Web Site, Intranet, Equipment or other direct, indirect, special, consequential or incidental damages) resulting from, arising out of or in connection with the construction, acquisition, delivery, installation, commissioning, testing use or possession of the Web Site or the supply of any services by Web Design By The Bay irrespective of whether such loss or damage or injury is claimed in contract or tort or under statute or otherwise.
Licensing
Any software used in the development of a website will be licensed by Web Design By The Bay, unless licensing is included in the quote.
Support
Web Design By The Bay will provide a reasonable level of on-going support in relation to the work it undertakes. Support staff can be contacted using specified support email address, fax and telephone numbers (during business hours).
Additional Work
Additional work outside the scope of the deliverables and on-going support will be charged at $110 per hour( in half an hour lots of $55) during standard work hours and $145 for urgent after hours work, weekends, and public holidays. Additional work will be billed upon completion. Payment is due within 14 days, otherwise an additional monthly charge of $15 occurs. Any invoices not paid by 2 months, means all changes will be revoked.
Travel Expenses
All travel expenses will be charged at cost.
